Terms of Service

1. General Provisions

  1. These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using all services provided by JANAI SCHOOL (hereinafter referred to as the “Provider”), including “Five Minute Japanese” and “Earth Gohan Lab” (hereinafter collectively referred to as the “Service”).

  2. By using the Service, users are deemed to have agreed to these Terms.

2. Definitions

In these Terms, the following definitions apply:

  1. User: An individual who agrees to these Terms, completes the registration process specified by the Provider, and is approved by the Provider to use the Service. This also includes individuals who use the Service through an external platform, provided that they agree to the terms and conditions of such platform.

  2. Content: All data, text, images, audio, video, programs, and other information provided through the Service.

  3. Intellectual Property Rights: Includes copyrights, patent rights, utility model rights, design rights, trademark rights, know-how, trade secrets, and all other intellectual property rights (including the right to apply for registration of such rights).

3. Account Registration

  1. Users must provide truthful, accurate, and complete information when registering for an account.

  2. Users are responsible for managing their account credentials (such as user ID and password) securely.

  3. Users may not transfer, lend, or share their account credentials with any third party under any circumstances. The Provider is not liable for any damages resulting from improper management or unauthorized use of account credentials.

  4. If a user becomes aware of unauthorized use of their account, they must promptly notify the Provider and follow its instructions.

4. Service Overview

  1. The Service is a platform that provides language learning, food and culture-related content, and opportunities for community engagement and events.

  2. The Service may include certain features or content provided through external platforms. Users must comply with the terms and conditions of such platforms, as well as any rules separately established by the Provider.

  3. Access to all features of the Service requires payment of the designated subscription fee. Some content may be available for free.

  4. The Provider may modify, add, or remove content or features of the Service at its discretion without prior notice.

5. Fees and Payment

  1. The fees for the Service shall be determined and displayed by the Provider for each service. The Provider may change the fees in response to changes in economic conditions or other relevant circumstances.

  2. Payments must be made via the method designated by the Provider, and any processing fees shall be borne by the user.

  3. For monthly plans, the fee is charged automatically each month. For annual plans, the fee is charged automatically once per year.

  4. The Provider will provide a refund only for annual subscription plans, if requested by the User within 14 days from the start date of the initial contract (14-day money-back guarantee). Monthly subscription plans are non-refundable under any circumstances. After this period, no refunds will be issued, except as required by law.

  5. Monthly subscriptions are renewed automatically on the same calendar day as the initial subscription. If the date does not exist in a given month (e.g., the 31st), the renewal occurs on the last day of that month.

    Example: A subscription starting on August 31 will renew on September 30, then continue renewing on the 30th until February, when it will renew on the 28th and continue on the 28th thereafter.

  6. If payment fails three times within a 10-day period, the Provider may automatically cancel the subscription, and the user will lose access to the Service.

  7. The 14-day money-back guarantee is only available for first-time subscribers and may only be used once per individual, regardless of the number of accounts or email addresses used.
    Abuse of this policy may result in the suspension or termination of your account.

  8. The fees, payment methods, cancellation policies, and other conditions for one-on-on sessions shall be separately determined and displayed by the Provider, and Users shall comply with such conditions.

6. Cancellation

  1. Users may cancel their subscription at any time through the account settings page, in accordance with the method specified by the Provider.

  2. Once the cancellation procedure is completed, the contract will terminate at the next automatic renewal date. Users may continue to use the Service until the end of the current billing period.

  3. If a full refund is requested under the 14-day money-back guarantee, the subscription will be canceled immediately upon completion of the request, and access to the Service will be lost at that time.

  4. No refunds will be provided for any fees already paid as of the completion of the cancellation procedure. In the case of annual plans, no refunds will be made for the remaining period of the subscription.

  5. Users remain responsible for any actions taken and consequences arising from their use of the Service prior to cancellation.

7. Intellectual Property Right

  1. All intellectual property rights in the Service and its related content (including text, images, videos, audio, and programs) belong to the Provider or their rightful owners.

  2. Users may use the content solely for personal learning purposes. Reproduction, modification, distribution, public transmission, sale, or lending of content without prior written consent from the Provider is strictly prohibited.

  3. If a user violates these Terms by using the content unlawfully, the Provider may claim compensation for any resulting damages.

  4. Users grant the Provider a non-exclusive, royalty-free license to use any content they post within the Service. This license includes the rights to reproduce, display, and otherwise use such content for the purposes of providing, operating, improving, and distributing related content of the Service.

8. Prohibited Conduct

  1. Users may not engage in any of the following actions while using the Service:

    (1) Violating laws or public order and morals

    (2) Engaging in criminal activity

    (3) Infringing on the rights or interests of the Provider, other users, or third parties

    (4) Damaging or interfering with the Provider’s servers or networks

    (5) Obstructing or threatening to obstruct the operation of the Service

    (6) Unauthorized use of another user’s account

    (7) Providing benefits to antisocial forces in connection with the Service

    (8) Harassing or harming other users or third parties

    (9) Impersonating others

    (10) Advertising, soliciting, or conducting business on the Service without permission

    (11) Seeking inappropriate or romantic encounters with strangers.

    (12) Disrupting the order of the community.

    (13) Using the Service for any unlawful or unauthorized purposes

    (14) Any other behavior the Provider deems inappropriate

  2. If a user violates or is deemed to have violated any of the above, the Provider may, at its sole discretion and without prior notice, take any of the following actions:

    (1) Temporarily suspend access to the Service

    (2) Delete the user’s account

    (3) Terminate the user’s contract

    (4) Seek compensation for damages

    (5) Take any other action deemed necessary

  3. The measures set forth in the preceding paragraph shall be taken at the discretion of the Provider. The Provider is under no obligation to disclose the reasons for such actions.

  4. Even if a User suffers damages as a result of measures taken under this Article, the Provider assumes no liability for such damages.

9. Service Suspension

  1. The Provider may suspend or discontinue all or part of the Service without prior notice in the following cases:

    (1) Regular or emergency maintenance of the system

    (2) Inability to operate the Service due to technical issues, high traffic, unauthorized access, or other disruptions

    (3) Service disruptions caused by third-party services used by the Provider

    (4) Force majeure events such as natural disasters, fires, or power outages

    (5) Difficulty in continuing all or part of the Service due to management, technical, or other business reasons

  2. The Provider shall not be liable for any damages incurred by users due to such suspension or discontinuation.

10. Disclaimers and Limitation of Liability

  1. The Provider does not guarantee that the Service is free from defects (including but not limited to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, or security, as well as errors, bugs, or rights infringements), whether express or implied.

  2. Language learning outcomes may vary between individuals, and the Provider makes no guarantees regarding specific achievements or proficiency levels.

  3. The Provider does not guarantee the accuracy, currency, or completeness of the content provided through the Service. Users shall use such content at their own discretion and responsibility, and the Provider shall not be liable for any damages arising therefrom.

  4. The Provider assumes no responsibility for service interruptions, termination, or data loss caused by platform malfunctions or shutdowns.

  5. The Provider shall not be liable for any damages caused to users by temporary suspension, interruption, or changes to the Service.

  6. The Provider shall not be liable for any damages incurred by users in connection with the Service, except in cases of willful misconduct or gross negligence by the Provider.

  7. The Provider shall not be liable for any transactions, communications, or other disputes between users or between a user and a third party in relation to the Service.

11. Confidentiality

  1. Users shall maintain the confidentiality of any non-public information disclosed by the Provider that is designated as confidential, unless they obtain prior written consent from the Provider.

  2. The Provider shall handle users' personal information in accordance with its Privacy Policy.

12. Deregistration and Withdrawal

  1. Users may withdraw from the Service and delete their user registration by contacting the Provider with the required information and a statement of intent to withdraw. To cancel only a subscription and not the entire user account, users may do so from their account settings.

  2. If a user has any outstanding obligations to the Provider at the time of withdrawal, the user shall immediately forfeit any benefit of term and must pay all amounts owed without delay.

  3. The handling of user data after withdrawal will be in accordance with the Provider’s Privacy Policy.

  4. Any user-generated content (such as posts or comments) may remain visible at the discretion of the Provider even after withdrawal.

13. Amendments to the Terms

  1. The Provider may revise these Terms at any time without prior notice to users, if deemed necessary.

  2. Revised Terms shall take effect upon being posted on the Service’s website. By continuing to use the Service after any modifications, users are deemed to have accepted the revised Terms.

14. Notices and Communications

  1. All notices and communications between users and the Provider shall be made using the method specified by the Provider.

  2. Unless a user has submitted a change request via the prescribed method, the Provider will consider the user’s registered contact information valid and will deem any communication sent to that contact as delivered at the time of transmission.

15. Non-Transferability of Rights and Obligations

Users may not assign, transfer, or pledge their status under the service agreement or any rights or obligations under these Terms to any third party without the prior written consent of the Provider.

16. Governing Law and Jurisdiction

  1. These Terms shall be governed by and interpreted in accordance with the laws of Japan.

  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

17. Language

These Terms are originally written in Japanese. If a translated version conflicts with the Japanese version, the Japanese version shall take precedence.

18. Survival

The provisions of Article 7 (Intellectual Property), Article 10 (Disclaimer of Warranties and Limitation of Liability), Article 11 (Confidentiality), Article 16 (Governing Law and Jurisdiction), and this Article 18 (Survival) shall remain in effect even after the termination of the service agreement.
